§ 1. General provisions

1. These Terms and Conditions define the rules, conditions and scope of providing electronic services via the online store available at https://e-sklep.flexidesign.eu/ (hereinafter: the “Store” or the “Service”).

2. The Terms and Conditions specify in particular:

types and scope of services provided electronically,

conditions for providing electronic services, including technical requirements,

rules for placing orders and concluding sales contracts,

rules for delivering digital content and granting licenses,

rules for providing paid technical support,

complaint procedures,

rules for withdrawal from the contract,

the prohibition of providing unlawful content.

3. These Terms and Conditions are made available free of charge in the Store in a form enabling their acquisition, reproduction and recording using the ICT system used by the Customer.

4. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, and provisions concerning personal data protection. Information about the loss of the right of withdrawal for digital content should be provided before the start of delivery, and the loss of this right requires fulfillment of the conditions provided for digital content not supplied on a tangible medium.

§ 2. Definitions

The terms used in these Terms and Conditions mean:

Seller / Service Provider – Flexi Design Jarosław Zakrzewski, ul. Stefana Żeromskiego 1 lok. 409, 01-887 Warsaw, Poland, NIP: 8381761147, REGON: 367711923.

Customer – a natural person, legal person or organizational unit without legal personality using the Store or concluding a contract with the Seller.

Consumer – a Customer who is a natural person performing a legal transaction not directly related to their business or professional activity.

Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of the contract shows that it does not have a professional character for that person.

Store / Service – the online store operated at https://e-sklep.flexidesign.eu/.

Customer Account – an individual panel in the Store enabling, among other things, access to purchased files for the period specified in these Terms and Conditions.

Product – a digital product offered in the Store, in particular a plugin, extension, script, installation file, downloadable file, update, or license.

Digital Content – data created and delivered in digital form, in particular installation files, archives, updates, documentation, license keys and other downloadable files.

Support Service – paid technical assistance, consultation or support regarding Products provided by the Seller for remuneration of PLN 180.00 net per hour, unless otherwise specified in the offer.

License – authorization to use the Product under the terms specified in the Product description, these Terms and Conditions or separate license conditions.

Order – a declaration of intent by the Customer directly aimed at concluding a sales contract for a Product or a contract for the provision of a Support Service.

Contract – a contract concluded between the Seller and the Customer via the Store.

Business day – a day from Monday to Friday excluding public holidays.

§ 4. Types and scope of electronic services

1. The Seller provides the following electronic services via the Store:

enabling browsing of the Store’s offer,

enabling the creation and maintenance of a Customer Account,

enabling the placement of Orders,

making purchased Products available for download,

providing access to order history and files in the Customer Account,

contacting the Customer via e-mail,

providing paid technical support if the Customer chooses such a service.

2. The main subject of the Store’s activity is the sale of digital content, in particular:

plugins and extensions for Joomla,

plugins and extensions for WordPress,

plugins, scripts and extensions for Adobe InDesign,

plugins, scripts and extensions for Adobe Photoshop,

updates, installation files, documentation and licenses related to the above products.

3. Using the Store for browsing the offer and creating a Customer Account is free of charge. Products and Support Services are paid.

§ 5. Conditions for providing electronic services

1. Technical requirements necessary to use the Store:

a device with Internet access,

a current web browser supporting cookies and JavaScript,

an active e-mail account,

access to software enabling opening or installation of purchased files according to the Product description,

for selected Products – possession of an appropriate version of Joomla, WordPress, Adobe InDesign, Adobe Photoshop or another environment specified in the Product description.

2. The Customer is obliged to use the Store in accordance with the law, these Terms and Conditions and good practices.

3. It is prohibited to provide unlawful content, content infringing the rights of third parties, containing malicious software, or intended to disrupt the functioning of the Store.

4. The Seller may temporarily limit access to the Store due to technical, security or maintenance reasons.

§ 6. Customer Account

1. Creating a Customer Account requires providing the data indicated in the registration form and accepting these Terms and Conditions.

2. The Customer is obliged to provide true and up-to-date data.

3. Purchased files are available in the Customer Account for a period of 1 year from the date of purchase unless the Product description states otherwise.

4. After the period referred to in paragraph 3, the Seller may discontinue providing download access in the Customer Account without affecting the scope of the granted License unless the License terms state otherwise.

5. The Customer should secure the login credentials for the Customer Account against unauthorized access.

§ 7. Rules for placing Orders and concluding Contracts

1. The Customer places an Order by adding a Product or Support Service to the cart, completing the Order form and making payment.

2. To place an Order the Customer provides the data necessary to perform the Contract, in particular name and surname or company name, e-mail address, billing details and, if necessary, phone number.

3. Placing an Order constitutes an offer by the Customer to conclude a Contract.

4. The Contract is concluded upon confirmation of acceptance of the Order by the Seller or upon successful payment and display of confirmation, depending on the sales process adopted in the Store.

5. Confirmation of the Contract is sent to the Customer on a durable medium, in particular via e-mail.

6. The Seller may refuse to process an Order in the case of false data, payment issues or justified suspicion of violation of these Terms and Conditions.

§ 8. Prices and payment methods

1. Prices of Products presented in the Store are given in Polish zloty (PLN).

2. Unless stated otherwise in the Product description, prices shown to consumers are gross prices.

3. Paid technical support is provided at a rate of PLN 180.00 net per hour unless an individual offer states otherwise.

4. Available payment methods include in particular online payment via the payment operator Tpay.

5. The Seller may also provide other payment methods currently indicated in the Store.

§ 9. Delivery of digital Products

1. Products constitute digital content delivered without a tangible medium.

2. Delivery of the Product takes place immediately after the payment is recorded or confirmed by the payment operator unless the Product description states otherwise.

3. The Product may be delivered through:

a download link sent by e-mail,

access to the file in the Customer Account,

providing a license key, activation code or download instructions.

4. The Customer should download and secure the Product on their own. Download access in the Customer Account is provided for 1 year from purchase unless the Product description states otherwise.

5. The Seller is not responsible for inability to properly use the Product if it results from failure to meet technical requirements or using an unsupported software version.

§ 10. License and rules of using Products

1. Upon delivery of the Product, the Customer receives a non-exclusive, non-transferable license to use the Product within the scope specified in the Product description or separate license terms.

2. Unless the Product description states otherwise, the Customer is not authorized to:

resell the Product,

share the Product with third parties,

publish source or installation files,

remove authorship markings, security mechanisms or license information,

use the Product in a way that infringes the rights of the Seller or third parties.

3. The scope of allowed modification of the Product, the number of installations, the support period and update rules may result from the description of a specific Product.

§ 11. Paid technical support

1. The Seller may provide paid technical support regarding Products.

2. Technical support covers only the scope agreed with the Customer and does not automatically include individual programming, implementation or graphic work unless otherwise agreed.

3. Support services are billed at the rate of PLN 180.00 net per hour.

4. If the support service is provided before the expiration of the withdrawal period, its commencement requires appropriate consents and information required by consumer law.

§ 12. Right of withdrawal

1. Consumers and entrepreneurs with consumer rights generally have the right to withdraw from a distance contract within 14 days unless a statutory exception applies.

2. In the case of a contract for the supply of digital content not supplied on a tangible medium, the right of withdrawal does not apply if:

the Customer has given prior explicit consent to begin delivery of the digital content before the withdrawal period expires,

the Customer has been informed about the loss of the right of withdrawal and acknowledged it,

the Seller has provided confirmation of the contract and consent on a durable medium.

3. If the above conditions are not met, statutory consumer rights remain applicable.

4. After effective commencement of digital content delivery under paragraph 2, the Customer is not entitled to a refund solely due to downloading or accessing the file.

5. For Support Services, the provisions applicable to distance service contracts apply.

§ 13. Complaints and conformity with the contract

1. The Seller is responsible for the conformity of the Product or Support Service with the Contract.

2. Complaints may relate in particular to:

inability to download the Product,

file damage,

inconsistency of the Product with its description,

incorrect operation of the Product within the declared requirements,

lack of access to the purchased Product in the Customer Account within the period specified in these Terms and Conditions,

improper performance of the Support Service.

3. Complaints should be submitted to: e-sklep@flexidesign.eu.

4. The complaint should contain data allowing identification of the order, description of the problem and the Customer’s request.

5. The Seller will consider the complaint within 14 business days or within the period resulting from applicable law.

6. If the complaint is accepted, the Seller will bring the Product or Service into conformity with the Contract, reduce the price or refund the payment depending on the circumstances and legal requirements.

7. The provisions of this paragraph do not exclude or limit statutory rights of Consumers or Entrepreneurs with consumer rights.

§ 14. Personal data protection

1. The Seller is the controller of Customers’ personal data.

2. Detailed rules of personal data processing are described in the Privacy Policy available in the Store.

§ 15. Intellectual property

1. All rights to the Store, Products, descriptions, graphics, materials and content placed in the Service belong to the Seller or appropriate third parties.

2. Use of Products and content available in the Store is permitted only within the scope of the granted License and applicable law.

§ 16. Final provisions

1. The Seller reserves the right to change these Terms and Conditions for important reasons, in particular due to changes in law, payment methods, Store functionality or the sales model.

2. Changes to the Terms and Conditions do not infringe the acquired rights of Customers who concluded a Contract before the changes came into force.

3. For Customers who are Consumers, the competent court is determined by applicable legal provisions.

4. These Terms and Conditions enter into force on 8 March 2026.
